Borgata Casino Babes Lose Weight Gain RulingThe “Borgata Babes” have lost their weight gain lawsuit filed against their employer the Borgota Hotel Casino & Spa, after Superior Court Judge Nelson Johnson ruled the casino’s policy does not constitute sexual discrimination.
The lawsuit had originally been filed by 22 cocktail waitresses who claimed that the Borgata casino’s dress code for servers created a culture of humiliation, further exasperated by a policy prohibiting them from gaining more than 7% of the weight they were when first hired. Some of the women even went so far as to claim they were advised to take laxatives before mandatory weigh-ins or instructed to stop taking prescription medications that could cause weight gain.
Other complaints include one “Borgata Babe” claiming she was disciplined for eating a cookie, and another being publicly asked if she was pretending to be pregnant and “just getting fat.”
Nevertheless, Superior Court Judge Nelson Johnson ruled that when your job description has the title”babe” in it, it is not unreasonable to expect your employer to have an interest in your weight, despite explaining that “from the court’s perspective, the term ‘babe’ is at best undignified and at worst degrading.”
As Judge Nelson Johnson went on to elaborate: “The Borgata Babe program has a sufficient level of trapping and adornments to render its participants akin to ‘sex objects’ to the Borgata’s patrons. Nevertheless, for the individual labeled a babe to become a sex object requires that person’s participation. Plaintiffs cannot shed the label babe; they embraced it when they went to work for the Borgata.”
The judges findings seem to be borne out by the “Borgata Babes” job description which requires that they be dressed in a miniskirt, a cleavage-showing top, black tights and high heels, with the Borgota Hotel Casino & Spa making it clear in its brochure that meeting one should entail the following experience:
“She moves toward you like a movie star, her smile melting the ice in your bourbon and water. You forget your own name. She kindly remembers it for you. You become the most important person in the room. And relax in the knowledge that there are no calories in eye candy.”
