New Jersey Online Poker Regulations

First introduced in late 2010, the bill passed the State Senate with a vote of 29-5 and again received the greenlight by the State Assembly with 63-11 vote in January. This in turn has pushed the bill forth to Gov Chris Christie for signing. Once signed, the bill will allow New Jersey to become the first state within the United States to full legalize and regulate online poker. Unlike any other bill brought forth to a state house, the S-490 / A2570 includes online poker sites, which means residents of the state will be able to play freely at any legal New Jersey poker site of their choice. Unfortunately, not all US poker sites will be made available to New Jersey players. Sites like FT shut down to US players due to an FBI investigation.

Under the New Jersey poker bill, the Casino Control Commission will establish a division of online betting with the intention of regulating how the betting occurs over the internet, including standards set for the software used. Poker sites that want to offer online poker in New Jersey will need to apply to the Commission for an "Internet wagering permit". The permit is renewed annually at a cost of no less than $100,000. All applicants, including offshore poker sites are subject to stringent regulations regarding accounts, and players that qualify to bet online. The software used by any operator must meet the standards of both the Commission and the Division of Gaming Enforcement. The bill in its original form, permitted New Jersey poker sites to accept bets from all players. After careful consideration and review from the General Assembly, the bill was revised. The revision revoked the ability to accept bets from all players, and implemented a charter whereby New Jersey poker rooms could only operate within the state of New Jersey. This means players will need to be a resident of the state and physically reside in New Jersey in order to create an account and have access to the games.

With the new bill, New Jersey poker players will be able to fund their accounts using check, cash, money order, debit card, credit card or ETF (electronic funds transfer), something that players from the state have had trouble with since the implementation of the UIGEA.

Governor Chris Christie has 45 days from the date of passing the State Assembly to sign the bill into law, veto it on condition or veto it entirely. The industry is buzzing that the bill will be signed since this is the third piece of legislation overhauling New Jersey's gambling industry. If signed, the bill would take effect July 4th. If Christie fails to meet the 45-day deadline, the bill will automatically become law.
